Four things account for
most of the deaths.

The equipment rules are federal, they are keyed to the length of your boat, and the thresholds come from regulations written decades apart in different units. Two of them changed recently enough that a lot of compliant-looking boats are not. This page covers what you must carry and why, what the labels on your life jackets mean now that the type codes are gone, what cold water actually does and on what timescale, and what the Coast Guard casualty data says about which of it matters most.

These are the federal minimums, and they are minimums. Your state almost certainly adds requirements — a boating safety certificate, PFD wear rules for children that differ from the federal age, registration, and equipment your state inspects for — and state law governs most of the water most people boat on. Nothing here is legal advice. Check your own state boating agency and the current eCFR before you rely on any of it.

What federal law makes you carry

Federal carriage requirements are keyed to the length of the boat, and the thresholds come from different regulations written at different times in different units. They do not line up. A 39-foot boat and a 40-foot boat differ in two separate requirements, and one of those thresholds is metric.

Every threshold in federal recreational carriage law on one axis. Length means the manufacturer's length, not the trailer
Vessel length for these purposes is the straight-line horizontal distance between the foremost and aftermost points of the hull, excluding attachments such as bow pulpits, swim platforms, outboard brackets and rub rails. It is the number on your capacity plate and on your registration. A boat sold as a "26" can measure under 26 feet by this definition and cross a legal threshold in doing so — and the engine cut-off switch rule and the extinguisher count both hinge on exactly that boundary.

Life jackets, and the labelling change nobody told you about

The requirement itself is short. Under 33 CFR 175.15, no person may use a recreational vessel unless at least one wearable PFD of the proper size is on board for each person, and a vessel 16 feet or longer also carries at least one throwable device. A separate section, 175.19, says where they must be: wearables readily accessible, throwables immediately available. All of them must be in serviceable condition and legibly marked with their approval. Canoes and kayaks of 16 feet and over are excused the throwable, and racing shells, sculls, racing canoes and kayaks and sailboards are excused PFDs altogether.

"Readily accessible" does not mean "on board"
A life jacket still in its packaging, under a pile of gear, in a locked compartment or at the bottom of the bow storage is not readily accessible and does not satisfy the rule. The 2024 casualty figures make the reason plain: 76 percent of boating deaths were drownings, and where life jacket use was known, 87 percent of those who drowned were not wearing one. Almost none of them had time to go and find it.

The confusing part is the labelling, and it took two rulemakings ten years apart. In 2014 the Coast Guard removed the Type I/II/III/IV/V codes from the approval regulations, harmonising with Canada, but the labels themselves did not change. The replacement arrived with the Lifejacket Approval Harmonization rule, effective 6 January 2025, which adopted performance levels — and only three of them, Level 50, 70 and 100. Level 150 and 275 exist in the international standard but the Coast Guard has not adopted them, so a US-approved recreational device will not carry one. New labels also show icons for turning performance and for the activities the device is not approved for. Older Type-marked jackets remain perfectly legal, so you can be carrying two approved devices whose labels share no vocabulary at all, and both are compliant.

Fire extinguishers, and the 2022 rule that expired a lot of them

Two things changed here recently, and both catch people out. First, recreational vessel fire equipment moved: it is now governed by 33 CFR part 175, subpart E, not by 46 CFR part 25, which explicitly excludes recreational vessels. Second, on 20 April 2022 a new classification and a service life came into force.

When you need one at all
33 CFR 175.320(a)(1) excuses a boat only when three things hold at once: it is under 26 feet, it is propelled by an outboard motor, and its construction will not permit the entrapment of explosive or flammable gases or vapours. All three, together — a 30-foot open centre console with outboards fails the first, and any inboard boat fails the second whatever its layout. What counts as entrapment is set out in the table to 175.320: closed compartments under thwarts or seats where portable tanks may be stored; double bottoms not sealed to the hull or not filled with flotation; closed living spaces; closed stowage holding flammable materials; permanently installed fuel tanks. Carrying one anyway costs about thirty dollars.

Visual distress signals

Visual distress signals are required on coastal waters — which for this purpose includes the Great Lakes, the territorial seas, and waters connected directly to them up to a point where the entrance is more than two nautical miles wide — and on the high seas. Not on inland lakes and rivers, though several states impose their own requirement there.

DO
  • Boats 16 feet and over carry signals for both day and night use.
  • Boats under 16 feet carry night signals only, and only when operating between sunset and sunrise.
  • Three hand-held red flares, or three parachute red flares, satisfy both day and night at once.
  • Mix and match: an orange flag (day) plus an electric distress light (night) is a legal, non-expiring combination.
  • Check the expiry. Pyrotechnics are good for 42 months from manufacture, and expired ones do not count toward the requirement.
DO NOT
  • Assume a phone counts. It does not, and coverage offshore is not a plan.
  • Rely on three orange smoke signals alone — smoke is day only.
  • Rely on an electric distress light alone — it is night only.
  • Carry expired flares as your only set. Keep them as a spare, clearly separated, and carry in-date ones as well.
  • Fire a flare with the wind behind the burning end, or over your own head. Hand-held flares drip.
Who is exempt
Under 33 CFR 175.115, three groups need carry only night signals, and only between sunset and sunrise: boats in organised races, regattas and parades; manually propelled boats; and open sailboats under 26 feet with no propulsion machinery. Note that this is a reduction, not an exemption — the night requirement still applies after dark.

Cut-off switches, ventilation and flame arrestors

Three requirements that are all about the engine, and one of them is much newer than the others.

    Engine cut-off switch — use required since 1 April 2021.
    46 USC 4312. The operator of a covered recreational vessel — less than 26 feet overall, capable of developing 115 pounds or more of static thrust — shall use the engine cut-off switch link while operating on plane or above displacement speed. This is a use requirement, not just a carriage requirement, and it is the newest federal boating law most people have never heard of. It does not apply if the main helm is inside an enclosed cabin, or if the vessel has no cut-off switch and is not required to have one. Wireless devices satisfy it.
  2. 2
    Backfire flame control — since 1940.
    46 CFR 25.35-1. Every gasoline engine installed in a motorboat after 25 April 1940, except outboard motors, must have an acceptable means of backfire flame control. In practice this is the flame arrestor on the carburettor or throttle body. It must be in place, clean, and secured; a missing or clogged arrestor is the most commonly written equipment violation on inboard boats.

    Ventilation — 33 CFR 183 subpart K.
    Boats with gasoline engines for propulsion, electrical generation or mechanical power need ventilation. Compartments with a permanently installed petrol engine and a cranking motor need powered ventilation — an exhaust blower — unless open to the atmosphere. Compartments with petrol tanks or certain electrical components need natural ventilation: supply and exhaust openings sized by the rule, with the exhaust opening or duct originating in the lower third of the compartment and above the normal bilge water level, because petrol vapour is heavier than air and pools at the bottom. Note which duct reaches down: in a powered system it is the blower intake that sits in the lower third (183.610(d)); in a natural system it is the exhaust (183.630).
Run the blower for four minutes and then use your nose
The blower is required equipment, and the four-minute rule before starting is the convention. It is not sufficient on its own: a blower moves the air in the compartment it is ducted to, and petrol vapour that has run into the bilge outside that duct will still be there. Open the engine hatch and smell the bilge before you start, every time, and always after fuelling. The nose detects petrol vapour at concentrations far below the lower explosive limit, which makes it a better sensor for this job than anything fitted to the boat.

Sound-producing devices

Rule 33 requires a whistle on a vessel of 12 metres (39.4 feet) or more, and a bell in addition at 20 metres (65.6 feet) or more. Below 12 metres you are not obliged to carry those specific appliances, but the rule does not let you off: such a vessel "shall be provided with some other means of making an efficient sound signal".

The small-boat exemption is about the appliance, not the signal
Being under 12 metres exempts you from carrying a Annex III-compliant whistle. It does not exempt you from Rule 34 or Rule 35 — you still have to sound the manoeuvring signals, the danger signal and the fog signals, and you still have to be audible. A cheap plastic mouth whistle on a lanyard round your neck satisfies the letter of it and is worth having regardless, because it works when the battery is flat and it works in the water after you have gone over the side.

Numbering, hull identification and the capacity plate

The capacity plate answers a stability question, not a comfort one
Persons capacity is derived from the boat's dimensions and its ability to stay afloat and stable with that load, assuming an average person weight that has not kept pace with the population. A boat rated for six people and a total of 1,000 pounds is rated for both numbers at once: six adults at 190 pounds each plus a cooler exceeds the weight limit while satisfying the person count. Weight is the one that actually governs.

Alcohol: first for deaths, seventh for accidents

Federal law sets the limit at 0.08 percent blood alcohol concentration for recreational vessels, and 0.04 percent for vessels other than recreational, at 33 CFR 95.020. A person is also under the influence, independently of any number, when the effect of the intoxicant on their manner, disposition, speech, muscular movement, general appearance or behaviour is apparent by observation — so a chemical test is evidence, not a threshold you get to sit just under. States set their own limits, which may be lower, and every state has a boating-under-the-influence offence.

It was the primary contributing factor in 244 of these accidents and 92 of these deaths -- fewer incidents than operator inattention, and more than twice the deaths of anything else on the table. The 2024 primary contributing factor table, ranked twice. Alcohol was seventh by number of accidents and first by number of deaths, and it is not close: 92 deaths against 55 for the next factor. Operator inattention causes more accidents than anything else and kills fewer than half as many people.

The reason boating amplifies alcohol is not folklore. Sun, wind, noise, vibration and motion produce fatigue and dehydration that degrade balance, reaction time and judgement on their own; alcohol adds to an already reduced baseline. The practical consequence is that the impairment at a given BAC is worse afloat than ashore, and that a person can be meaningfully impaired at a BAC below any legal limit. Add that most boats have no seat belts, no roll cage and a propeller, and the accident-to-death conversion rate is what the figure above shows it to be.

When you must file an accident report

The operator must file a casualty report when an occurrence involving the vessel or its equipment results in a death, a disappearance under circumstances indicating death or injury, an injury requiring medical treatment beyond first aid, or damage to vessels and other property totalling $2,000 or more, or the complete loss of any vessel.

The rendering-assistance duty is separate and it is criminal
Under 46 USC 2304, the master or individual in charge of a vessel is obliged, so far as they can do so without serious danger to their own vessel or persons aboard, to render assistance to any individual found at sea in danger of being lost. This is a distinct legal duty from the reporting requirement, it carries criminal penalties, and it applies whether or not you caused the situation. The corresponding Good Samaritan provision protects a person who gives reasonable assistance in good faith from civil liability for their acts in doing so.

Cold water, and why the popular rule is disputed

Cold water immersion kills in three distinct phases with different mechanisms and different timescales. Almost everybody has heard of hypothermia, which is the last and slowest of the three, and almost nobody drowns of it.

  1. 1
    Cold shock response — seconds to about two minutes.
    Sudden immersion in cold water triggers an involuntary gasp, then uncontrollable hyperventilation, a spike in heart rate and blood pressure, and loss of breath-hold ability. If your head is under water when the gasp comes, you inhale water. This phase kills more cold-water victims than hypothermia does, and it kills strong swimmers. A life jacket helps here specifically because it keeps your airway clear during the period when you cannot control your breathing.
  2. 2
    Cold incapacitation — minutes to tens of minutes.
    Peripheral cooling of nerve and muscle in the arms and legs progressively destroys grip strength, dexterity and swimming ability. You are still fully conscious, still warm at the core, and unable to pull yourself onto anything or hold on to it. This is the phase in which people are seen going under a few metres from a boat they cannot climb back into.
  3. 3
    Hypothermia — typically half an hour and upward.
    Core temperature falls, and consciousness with it. In water cold enough to make the first two phases lethal, hypothermia usually has not had time to develop. This is why the fact that "you have an hour before hypothermia" is both true and beside the point.
The 1-10-1 rule, and the argument against teaching it
What it says One minute to get your breathing under control, ten minutes of meaningful movement, one hour before you lose consciousness from hypothermia. Widely taught, including by boating councils, and attributed to the cold-water physiologist Gordon Giesbrecht. the popular version
The objection The National Center for Cold Water Safety argues the framing is unscientific and dangerous: Giesbrecht's own published work puts cold shock death at seconds to two minutes and incapacitation at two to thirty minutes, not a clean ten. Capability declines progressively rather than ending at a boundary, and the phrase "you have" implies a control over the cold shock response that people do not actually have. the criticism
What to take from it Use 1-10-1 as an ordering of the three phases, which is correct and useful, and not as a set of times you can plan against. The operative facts do not depend on the numbers: the jacket has to be on before you go in, self-rescue gets harder every minute, and in genuinely cold water thermal protection matters more than the flotation does. the practical rule

This is included because the disagreement is real and a study page that quoted the tidy version without it would be teaching a number its own originator's data does not support.

Carbon monoxide

Carbon monoxide is colourless, odourless, and produced by every petrol engine, generator and fuel-burning appliance on the boat. It binds to haemoglobin with roughly 200 times the affinity of oxygen, so exposure is cumulative and recovery is slow. Its early symptoms — headache, dizziness, nausea, drowsiness, weakness — are indistinguishable from seasickness, sunstroke and too much to drink, which is precisely why it is dangerous on a boat: everybody has a benign explanation ready.

The station wagon effect, and the swim platform
A boat under way at slow speed, or with a following wind at the same speed as the boat, can pull its own exhaust back into the cockpit and cabin in a recirculating eddy behind the transom. And the water immediately behind an idling boat — at the swim platform, or under the transom where children hold on for "teak surfing" or "platform dragging" — can hold lethal CO concentrations within minutes. People have died there while the engine was merely idling at the dock. If anybody aboard has those symptoms, get them into fresh air first and diagnose second.

Before you leave the dock

DO
  • File a float plan with somebody ashore: boat description and registration number, who is aboard, where you are going, when you expect to be back, and what they should do and who they should call if you are not. Then close it out when you return.
  • Check the marine forecast and the radar before you go, and again while you are out. Weather was the primary contributing factor in 55 deaths in 2024, more than any factor except alcohol.
  • Run the blower, then open the hatch and smell the bilge.
  • Count the life jackets against the people, and check that the smallest person has one that fits them.
  • Brief at least one passenger on how to work the radio, stop the engine, and get the boat back — the single point of failure on most small boats is the person driving it.
  • Use the one-third rule for fuel: a third out, a third back, a third in reserve.
DO NOT
  • Fuel with anybody aboard, the engine running, or anything electrical switched on. Everyone ashore, all hatches and ports closed, nozzle in contact with the fill.
  • Overfill. Petrol expands, and what comes out of the vent goes in the water and into the bilge.
  • Load to the person count and ignore the weight limit. The weight limit is the binding one.
  • Assume a phone is a distress signal. Carry a VHF; channel 16 reaches everybody within range including other boats, and the Coast Guard can take a bearing on it.
  • Set off without checking the fire extinguisher's date stamp. Since April 2022 the disposable ones expire at 12 years.

If the weather turns: get life jackets on everyone immediately, before you need them and while it is still easy to move around. Slow down. Head into the waves at an angle of about 45 degrees rather than taking them square on the bow or on the beam. Get low, keep weight centred and low, and head for the nearest lee shore rather than the one you set out for. Secure loose gear and close hatches and ports before you are busy.

What actually happens: the 2024 casualty data

The Coast Guard publishes recreational boating casualties annually. The 2024 edition, the most recent published as of August 2026, recorded 3,887 accidents, 556 deaths, 2,170 injuries and approximately $88 million in property damage, at a fatality rate of 4.8 deaths per 100,000 registered recreational vessels. The Coast Guard reported that death toll as the lowest in more than fifty years, though the phrase is from its press release rather than the report. Recent editions have appeared around the end of June, so the 2025 figures may already be out by the time you read this — check before quoting these.

WHERE FEDERAL LAW STOPS

State law, and what a boating safety certificate actually is

Almost everything above is federal. Most of what governs your day on the water is not. States set operator education requirements, minimum operator ages, PFD wear ages, personal watercraft rules, towing and water-skiing rules, speed and no-wake zones, registration, and their own equipment requirements on top of the federal minimums.

The state courses are written against the American National Standards for Basic Boating Knowledge, published through NASBLA, the National Association of State Boating Law Administrators. The standard is a list of learning objectives across content areas — the boat, equipment, trip planning, the marine environment, safe operation, emergency preparedness, and other water activities — plus requirements for course design and assessment. Under the NASBLA conformity assessment policy the assessment must run in aggregate to at least 50 questions, of which at least 10 must be state-specific — the 50 is the floor for the whole exam, not a national core with state questions bolted on — and each state sets its own passing score.

This page is not a course and confers nothing
There is no public question pool for boating safety. NASBLA publishes the objectives a course must cover; the actual test banks are private, and the exams are administered under state supervision. Nothing on this site is an approved course, and completing the quizzes here earns you no certificate that any state will recognise. What it can do is show you where your gaps are before you sit the real thing. Find your state agency through NASBLA and take the approved course — on the 2024 numbers, 69 percent of boating deaths involved an operator who had never taken one.
